Terms of Service

1. Acceptance of Terms
By accessing and using David PM ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
David PM provides Project Management as a Service (PMaaS), a human-AI hybrid solution for managing cross-functional projects. Our service includes:
- Weekly stakeholder check-ins via email
- Executive preview emails for your approval before team distribution
- Weekly status summaries sent to your team
- Project dashboard with progress tracking
- Human oversight on all AI-generated communications
- Support ticket system for change requests
All communications sent on your behalf are reviewed by our team before delivery.
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account and submit your project for review. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account.
3.3 Project Queue
Due to the human component of our service, we review all project submissions before scheduling activation. Onboarding takes 2-3 weeks from submission to kickoff. Prepaying for service months moves you to the priority queue for faster review.
4. Pricing and Payment
4.1 Service Fees
David PM is priced at $2,000 per project per month. This includes all service features with no per-user fees for your stakeholders.
4.2 Month-to-Month Billing
Service is billed monthly. There are no long-term contracts. You pay for the current month and can cancel at any time.
4.3 Cancellation
You may cancel your subscription at any time. Upon cancellation, you retain access through the end of your current billing period. No refunds are provided for partial months.
4.4 Price Changes
We may change our fees with 30 days notice. Price changes do not affect your current billing period.
5. Your Responsibilities
As a David PM customer, you agree to:
- Provide accurate project information and stakeholder contacts
- Review and approve Thursday executive preview emails in a timely manner
- Ensure you have permission to add stakeholders to your project
- Respond to escalations and requests for input
- Not use the Service for illegal purposes
6. Stakeholder Communications
When you add stakeholders to your project:
- You authorize us to send check-in emails to those stakeholders on your behalf
- You represent that you have the right to share their contact information
- Stakeholders will know they are communicating with David PM, not directly with you
- You remain responsible for the accuracy of information provided to stakeholders
7. Human-AI Service Model
David PM uses AI to assist with drafting communications, tracking progress, and identifying risks. You acknowledge that:
- AI-generated content is reviewed by humans before being sent
- AI systems may make errors, which human reviewers work to catch
- Final decisions about escalations and communications are made by humans
- You can submit tickets to request changes or corrections at any time
8. Intellectual Property
8.1 Our Property
The Service, including its software, design, and documentation, is owned by David PM and protected by intellectual property laws.
8.2 Your Content
You retain all rights to your project information and content. You grant us a license to use your content solely to provide the Service.
9. Confidentiality
We understand you share sensitive project information with us. We agree to:
- Keep your project information confidential
- Only share information with stakeholders you designate
- Never share your project information with other customers
- Require our team members to maintain confidentiality
We may use aggregated, anonymized usage data to improve our service. See our Privacy Policy and Data Security page for details.
10. Service Availability
We strive to provide reliable service. However, we do not guarantee uninterrupted availability. We may suspend service for maintenance with reasonable notice when possible.
11. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access continues through the end of your billing period
- We will stop sending communications to your stakeholders
- Your work content remains in your PM tools (Trello, Asana, etc.) — we only stored task metadata
- You may export your activity log within 30 days
- We delete DavidPM data 90 days after termination unless required by law
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAVID PM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE PRECEDING 12 MONTHS.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee specific project outcomes. Project success depends on many factors outside our control.
14. Changes to Terms
We may modify these Terms with 30 days notice. Continued use after changes constitutes acceptance. Material changes will be communicated by email.
